I have been contacted by a constituent who claims that the Republic of Ireland has failed to fully implement Articles 2 and 3 and Recital 17 of Directive 2004/48/EC on The Enforcement of Intellectual Property Rights by the deadline of 29th April 2006.

The constituent claims that this has culminated in “small EU intellectual property owners not being able to bring low value cases (under 15K) to court without solicitors and barristers”.

The Commission is requested to answer the following:

 

  1. Does the Commission monitor the implementation of Articles 2 and 3 and Recital 17 of Directive 2004/48/EC on The Enforcement of Intellectual Property Rights?
  2. Could the Commission confirm whether Ireland is in fact breaching these aforementioned articles and directive?
  3. If Ireland has broken EU law how does the commission intend to enforce it?
